These Terms of Service ("Terms") govern your use of HearClara (the "Service") provided by Curious Ventures LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old to use the Service. If you are a resident of the European Economic Area (EEA), you must be at least 16 years old, or the applicable age of digital consent in your country, to create an account. By creating an account, you represent and warrant that you meet this age requirement.
You are responsible for maintaining the confidentiality of your account and for all activity under it. We reserve the right to suspend or terminate your account at any time, without notice or liability, for any reason, including if you breach these Terms. We may also limit, suspend, or revoke access to particular features, including AI generation, where reasonably necessary to investigate misuse, enforce these Terms, protect the Service, protect other users, or comply with applicable law or third-party platform and provider requirements.
You agree not to misuse the Service, including attempting to access systems without authorization, reverse engineering the Service except where permitted by law, or using the Service for unlawful purposes.
In particular, you agree not to use the Service or its AI generation features to submit, request, generate, or attempt to generate content that is unlawful, abusive, harassing, hateful, sexually explicit, violent, fraudulent, infringing, or otherwise prohibited by these Terms, applicable law, or the policies of our third-party providers. You also agree not to probe, test, evade, reverse engineer, or bypass safety filters, moderation systems, rate limits, access controls, or other protective measures, and not to use automated means to generate excessive, abusive, or manipulative requests.
You agree not to use the Service for real-time or high-stakes translation in medical consultations, legal proceedings, allergy warnings, emergency response, safety-critical instructions, or any other setting where mistranslation or misinterpretation could cause injury, property damage, legal consequences, or other significant harm.
You may not scrape, bulk extract, copy, harvest, or otherwise use Service outputs, including generated text, translations, audio, prompts, metadata, or user-interface responses, to develop, train, fine-tune, benchmark, or improve a competing machine-learning model, dataset, product, or service.
You must also comply with applicable third-party provider terms and acceptable-use policies, including Google AI and Google Cloud policies for AI features and Paddle's Buyer Terms for payment-related services. Violations of those upstream policies may result in request blocking, feature restrictions, suspension, or termination.
Subscription options and features are described on our Pricing page. You may cancel your subscription at any time to prevent future billing. If you cancel, access continues until the end of your current billing period.
Payments, billing inquiries, charge processing, invoices, taxes, and refund processing are handled by Paddle as Merchant of Record. HearClara support can help with app and account questions and may help route refund-related support requests, but financial transactions and refund eligibility are subject to Paddle's Buyer Terms, our Refund Policy, and any non-waivable consumer rights.

You may contact support@hearclara.com for account assistance or to ask for help with a refund-related issue. To the maximum extent permitted by applicable law, including applicable consumer law, payments and refund processing remain handled by Paddle as Merchant of Record and refund eligibility is governed by Paddle's Buyer Terms, our Refund Policy, and any mandatory consumer rights that cannot be waived.
The phrases, translations, and masterclasses provided by the Service are generated using artificial intelligence (AI) and machine learning models. You acknowledge that AI is a rapidly evolving technology and that your use of these features is at your own risk.
Accuracy and Hallucinations: While we strive for high-quality educational content, AI models can "hallucinate," confidently presenting incorrect, nonsensical, or entirely fabricated information as fact. HearClara does not guarantee the accuracy, completeness, reliability, or usefulness of any AI-generated content. HearClara is a language-learning aid, not a definitive translation authority. You are responsible for verifying important translations, phrases, pronunciation guidance, and learning content with a native speaker, qualified professional, or reliable secondary source before relying on them.
No Professional Advice: The Service is designed strictly for language learning and entertainment purposes. You agree not to rely on AI-generated content for medical, legal, financial, psychological, or other professional advice, nor for instructions regarding real-world physical safety, emergency situations, allergies, medical care, legal rights, regulated services, or safety-critical decisions.
Offensive or Objectionable Content: Due to the nature of generative AI, the Service may occasionally produce output that is unpredictable, offensive, biased, or inappropriate. Such output does not represent the views or opinions of Curious Ventures LLC. By using the Service, you agree that we are not liable for any distress or damage caused by such content.
Usage Rights: Content generated by the Service is provided for your personal, non-commercial use within the HearClara application only. Curious Ventures LLC does not represent or warrant that AI-generated outputs are copyrightable, protectable, or exclusively owned by you. Subject to these Terms, we grant you a limited, personal, non-commercial, non-transferable license to use generated outputs within the Service. Reproducing, distributing, or using this AI-generated content for other commercial purposes is prohibited without our prior written consent.
We may host, reproduce, display, modify, remove, hide, de-rank, quarantine, or restrict access to generated content where reasonably necessary to operate the Service, enforce these Terms, moderate content, maintain safety or quality, protect users or service providers, comply with provider policies, or comply with law.
AI generation features may be limited, filtered, delayed, blocked, throttled, or unavailable at any time based on our internal safety systems, service-stability needs, cost-control needs, operational needs, or the rules and moderation decisions of our third-party AI providers.
When you use AI features, your prompts, generated outputs, and related metadata may be processed by HearClara and our service providers to generate translations, flashcards, audio, masterclasses, and related learning features. Generated cards, generated audio, and related metadata may be stored as app content.
We may store or retain prompts, input previews, generated-content metadata, usage counters, moderation events, safety categories, report history, and account-level abuse signals as reasonably necessary to operate the Service, provide support, run safety systems, review flagged content, prevent abuse, enforce these Terms, protect users and providers, and comply with legal obligations.
Curious Ventures LLC does not use your AI inputs or generated outputs to train or fine-tune internal machine-learning models. For more information about data practices, please review our Privacy Policy.
If we determine, or reasonably suspect, that your use of the Service or its AI features violates these Terms, applicable law, or third-party provider rules, we may reject requests, remove generated output, rate limit usage, throttle API access, block requests, apply warnings or strikes, temporarily suspend or permanently revoke AI-generation privileges, or suspend or terminate your account. We may take these actions with or without prior notice where reasonably necessary to protect the Service, preserve service stability, control abusive or excessive costs, protect our users, or protect our service providers.
Safety enforcement may apply even where a request is phrased indirectly, uses euphemisms, asks for a translation of an abusive or discriminatory opinion, or attempts to probe or evade moderation rules. Repeated policy-violating prompts may trigger escalating consequences, including strike accumulation, temporary AI-generation suspension, private-only treatment of future generated cards, hiding or quarantining previously published cards from public discovery surfaces, reporting or feature restrictions, and permanent loss of access to AI generation.
Content you generate or publish through the Service is not guaranteed to remain publicly visible. We may hide, de-rank, quarantine, remove, or otherwise restrict access to generated content where reasonably necessary for safety, quality, provider-policy compliance, abuse prevention, moderation review, or legal compliance. Abuse of community reporting or moderation systems may also result in reporting restrictions or other account-level enforcement.
Blocked, rejected, safety-filtered, or policy-violating AI requests may still count toward daily, weekly, or monthly usage limits, trial credits, or feature entitlements and do not by themselves create any right to a refund, restoration of credits, or other compensation. Any refund eligibility remains subject to Paddle's role as Merchant of Record, Paddle's Buyer Terms, our Refund Policy, and any applicable mandatory consumer rights.
To the maximum extent permitted by applicable law, including applicable consumer law, you agree to defend, indemnify, and hold harmless Curious Ventures LLC and its members, employees, contractors, agents, service providers, and affiliates from and against any third-party claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your content, harmful, unlawful, or infringing content that you submit, request, generate, publish, or use through the Service, your misuse of the Service, your violation of these Terms or applicable law, or your violation of third-party rights.
To the maximum extent permitted by applicable law, including applicable consumer law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. Curious Ventures LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Nothing in these Terms excludes, restricts, or modifies any non-waivable consumer guarantee, statutory warranty, mandatory right, or mandatory remedy that applies to you under applicable law.
To the maximum extent permitted by applicable law, including applicable consumer law, in no event shall Curious Ventures LLC, nor its members, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
We do not exclude or limit liability where doing so would be unlawful, including where applicable consumer law prohibits that exclusion or limitation.
We may update or modify these Terms from time to time. When we do, we will update the "Last updated" date above. Where appropriate or required, we may also provide notice of material changes by posting updated Terms, in-app notice, email, or other reasonable means. Your continued use of the Service after updated Terms become effective means you accept the updated Terms, except where applicable law requires otherwise.
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
